Zonwaves DME is a supplier of durable medical equipment (DME) and medical supplies. We are required by law to maintain the privacy of your protected health information (“PHI”), to give you this Notice of our legal duties and privacy practices, to follow the terms of the Notice currently in effect, and to notify you if a breach of your unsecured PHI occurs.
How We May Use and Disclose Your Health Information
For Treatment
We may use and share your PHI to provide, coordinate, and manage the equipment and supplies you receive. For example, we may contact your physician to confirm your prescription or medical order, verify that an item meets your medical needs, or coordinate delivery, setup, repairs, and refills.
For Payment
We may use and share your PHI to bill and collect payment for equipment and supplies we provide. For example, we may send claims and supporting documentation to Medicare, Medi-Cal, your health plan, or other payers; verify your eligibility and coverage; obtain prior authorization; and respond to payer reviews, audits, or appeals.
For Health Care Operations
We may use and share your PHI to run our business — for example, quality review, staff training, compliance auditing, and business planning.
Appointment, Delivery, and Service Communications
We may contact you about deliveries, required documentation, equipment service, repairs, refills, and similar matters related to your equipment or supplies, using the contact methods you have allowed.
Business Associates
We may share PHI with contractors who perform services for us (for example, billing, claims transmission, or secure data storage). They are required by written agreement and by law to safeguard your PHI.
As Required or Permitted by Law
We may use or disclose PHI without your authorization when the law requires or permits it, including: when required by federal, state, or local law; for public health activities; for health oversight activities such as audits and inspections (including by Medicare, Medi-Cal/DHCS, and HHS); in judicial and administrative proceedings in response to a court order or lawful process; for law enforcement purposes as permitted by law; to coroners, medical examiners, or funeral directors; to avert a serious threat to health or safety; for workers’ compensation programs; and for specialized government functions authorized by law. Some of these disclosures are subject to additional limits under California law.
Persons Involved in Your Care
Unless you object, we may share information directly relevant to a family member, friend, or caregiver’s involvement in your care or in payment for your care, or notify them of your location or general condition. You may ask us not to.
Incidental Uses
Some uses or disclosures may occur incidentally to a permitted use (for example, another person overhearing a delivery confirmation). We use reasonable safeguards to limit these.
Uses and Disclosures That Require Your Written Authorization
We will obtain your written authorization before: using or disclosing your PHI for marketing purposes; selling your PHI; or making any use or disclosure not described in this Notice. Zonwaves DME does not use or disclose PHI for fundraising. We do not maintain psychotherapy notes; if we ever received them, most uses would require your authorization. If you give us an authorization, you may revoke it in writing at any time, except to the extent we have already acted in reliance on it.
California note. California law (the Confidentiality of Medical Information Act) may provide additional protections and may require a specific written authorization for certain disclosures beyond what federal law requires. Where California law is stricter, we follow California law.
Your Rights Regarding Your Health Information
- Right to Access. You may inspect and obtain a copy of your PHI in our records, in paper or electronic form, with limited exceptions. We may charge a reasonable cost-based fee for copies.
- Right to Amend. If you believe information in our records is incorrect or incomplete, you may request an amendment in writing. We may deny the request in certain cases; if so, we will tell you why in writing and how you may respond.
- Right to an Accounting of Disclosures. You may request a list of certain disclosures of your PHI we made in the six years before your request (this does not include disclosures for treatment, payment, operations, or those you authorized).
- Right to Request Restrictions. You may ask us to limit how we use or share your PHI. We are not required to agree to every request — but if you (or someone on your behalf, other than your health plan) pay for an item or service in full, out of pocket, and you ask us not to tell your health plan about it, we must agree, unless the law requires the disclosure.
- Right to Confidential Communications. You may ask us to contact you in a specific way or at a specific location (for example, only at a certain phone number or address). We will accommodate reasonable requests.
- Right to a Paper Copy. You may request a paper copy of this Notice at any time, even if you agreed to receive it electronically. Copies are free.
- Right to Breach Notification. We will notify you if a breach occurs involving your unsecured PHI, as required by law.

Changes to This Notice
We reserve the right to change this Notice and to make the revised Notice effective for PHI we already have as well as PHI we receive in the future. The current Notice, with its effective date, will always be posted on our website, and you may request a copy at any time.
Complaints
If you believe your privacy rights have been violated, you may file a complaint with us at the contact above, or with the Secretary of the U.S. Department of Health and Human Services, Office for Civil Rights, 200 Independence Avenue S.W., Washington, D.C. 20201, or online at hhs.gov/ocr. You will not be penalized or retaliated against in any way for filing a complaint.
